These Terms of Service ("Terms") govern your access to and use of trykakiya.com (the "Site"), operated by Kakiya Inc., a Corporation registered under Business Number 987654321 RC0001, with its registered address at 1234 Rue Principale, Suite 200, Halifax, NS B3H 4R2, Canada ("Kakiya", "we", "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover your use of the website itself. Purchases are separately governed by our Terms of Sale, and your personal information is handled as described in our Privacy Policy.
1. Eligibility
You must be at least the age of majority in your province or territory of residence to place an order on the Site. By using the Site, you confirm that the information you provide is accurate and complete.
2. Your account
You may be able to create an account to manage your orders. You are responsible for keeping your login details confidential and for all activity that takes place under your account. Please contact us at contact@trykakiya.com if you believe your account has been used without your authorisation.
3. Acceptable use

All content on the Site — including the Kakiya name and logo, text, product photography, illustrations, video and page layouts — is owned by Kakiya or used under licence, and is protected by Canadian and international intellectual property law. You may view and print content for your own personal, non-commercial use. Any other reproduction, distribution, modification or commercial use requires our prior written consent.
5. Content you submit
If you submit a review, comment, photo or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with the Site and our marketing. You confirm that you own the content or have the right to share it, and that it is not unlawful, misleading or offensive. We may remove any submitted content at our discretion.
6. Product information
We take care to describe our products accurately, but we do not warrant that descriptions, photos, pricing or availability are error-free or current at all times. We may correct errors and update or discontinue products at any time without notice.
7. Health disclaimer
Our products are cosmetics intended for external use. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Content on the Site is provided for general information only and is not medical advice. Results vary from person to person. If you are pregnant or nursing, have a skin condition, or are under medical care, consult a healthcare professional before use, and always patch-test a new product.
8. Third-party links and services
The Site may link to or integrate third-party websites and services (payment processors, shipment tracking, analytics, social platforms). We do not control those services and are not responsible for their content, practices or privacy policies. Your use of them is governed by their own terms.
9. Availability of the Site

10. Disclaimer and limitation of liability
To the fullest extent permitted by applicable law, the Site is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by applicable law, Kakiya will not be liable for indirect, incidental, special or consequential damages arising from your use of the Site, and our total liability relating to the Site is limited to the amount you paid us in the twelve months preceding the claim. Nothing in these Terms limits any right you have under the consumer protection legislation applicable in your province or territory of residence.
11. Indemnity
You agree to indemnify and hold Kakiya harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third-party right.

We may update these Terms at any time. The version in force is the one published on this page, and the "last updated" date above indicates when it was last revised. Continued use of the Site after a change constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any dispute will be submitted to the competent courts of Nova Scotia, without prejudice to any mandatory right you have to bring proceedings in your own province or territory of residence.
