1. Who we are

Kakiya Inc., a Corporation registered under Business Number 987654321 RC0001, with its registered address at 1234 Rue Principale, Suite 200, Halifax, NS B3H 4R2, Canada ("Kakiya", "we", "us"), operates the website trykakiya.com. These Terms of Sale govern every order placed on this site.

2. Products

We sell body care and cosmetic products. Product photos and descriptions are provided as accurately as possible, but minor variations (colour, texture, packaging) may occur. Our products are cosmetics: they are not intended to diagnose, treat, cure or prevent any disease, and results vary from person to person.

3. Prices

Prices are displayed in CAD and include applicable taxes unless stated otherwise. Shipping costs are shown at checkout before you confirm your order. We reserve the right to change prices at any time; the price applicable to your order is the one displayed when you place it.

4. Order process

An order is confirmed once you complete checkout and receive an order confirmation email. We reserve the right to refuse or cancel any order, in particular in case of a stock issue, a pricing error, or suspected fraud. If we cancel a paid order, you will be fully refunded.

5. Payment

Payment is processed securely through Shopify Payments and/or our other payment providers (credit card, PayPal, etc.). We do not store your full card details. Your order is processed once payment has been authorised.

6. Shipping

Shipping times and rates are described in our Shipping & Returns Policy. Ownership and risk of loss of the products transfer to you upon delivery to the carrier.

7. Returns and refunds

Our return and refund conditions, including our money-back guarantee where applicable, are described in our Refund Policy.

8. Right of withdrawal / cancellation

Where applicable under the consumer protection laws of your province of residence, you may have the right to cancel your order within a set period after delivery. See our Refund Policy for the applicable conditions and timeframe.

9. Warranty

Products are covered by the legal warranties provided under the consumer protection legislation applicable in your province of residence (including, where applicable, the Consumer Protection Act). These Terms of Sale do not limit any right you have under such legislation.

10. Limitation of liability

To the fullest extent permitted by applicable law, Kakiya's liability for any claim relating to an order is limited to the amount paid for that order. We are not liable for indirect, incidental or consequential damages.

11. Governing law and disputes

These Terms of Sale are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without prejudice to any mandatory consumer protection rights you have under the laws of your own province of residence. Any dispute shall be submitted to the competent courts of that province.
